SUPREMACY; INCORPORATION; NO INDEPENDENT RIGHTS: THIS POLICY IS EXPRESSLY INCORPORATED INTO AND GOVERNED BY THE HERPTIVARIUS, LLC TERMS & CONDITIONS, EMPLOYEE POLICIES, SAFETY POLICIES, AND ALL OTHER GOVERNING DOCUMENTS AND IS STRICTLY SUBORDINATE THERETO. NO PROVISION OF THIS POLICY CREATES ANY INDEPENDENT RIGHT, WARRANTY, OR REMEDY OUTSIDE THE SOLE AUTHORITY OF THE GOVERNING AGREEMENTS AND APPLICABLE LAW.
PURPOSE AND SAFETY PRINCIPLE: HERPTIVARIUS, LLC MAINTAINS A ZERO TOLERANCE STANDARD REGARDING CONTROLLED SUBSTANCES, IMPAIRMENT, AND HIGH-RISK REGULATED CONDUCT IN CONNECTION WITH COMPANY OPERATIONS. THIS POLICY EXISTS TO PROTECT ANIMAL WELFARE, HUMAN SAFETY, OPERATIONAL INTEGRITY, TRANSPORT SAFETY, REGULATORY COMPLIANCE, AND PUBLIC TRUST.
SCOPE OF APPLICATION: THIS POLICY APPLIES TO ALL OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, TEMPORARY WORKERS, AND ANY INDIVIDUAL ACTING ON BEHALF OF OR REPRESENTING HERPTIVARIUS, LLC, INCLUDING DURING WORK HOURS, ON COMPANY PREMISES, DURING TRANSPORTATION OR DELIVERY ACTIVITY, DURING SHIPPING OR HANDLING OF ANIMALS OR MERCHANDISE, DURING TRADE EVENTS, AND DURING ANY ACTIVITY WHERE AN INDIVIDUAL COULD REASONABLY BE PERCEIVED AS REPRESENTING THE COMPANY.
ZERO TOLERANCE STANDARD FOR CONTROLLED SUBSTANCES AND IMPAIRMENT: THE USE, POSSESSION, SALE, DISTRIBUTION, TRANSFER, OR IMPAIRMENT BY MARIJUANA, THC, CANNABIS PRODUCTS, OR ANY CONTROLLED SUBSTANCE IS STRICTLY PROHIBITED DURING ANY COMPANY-RELATED ACTIVITY. THIS PROHIBITION APPLIES REGARDLESS OF STATE OR LOCAL LEGALIZATION STATUS AND REGARDLESS OF WHETHER SUCH SUBSTANCES ARE USED FOR MEDICAL OR RECREATIONAL PURPOSES. NO INDIVIDUAL MAY REPORT TO OR REMAIN ON DUTY WHILE IMPAIRED OR SUSPECTED OF BEING IMPAIRED. IMPAIRMENT INCLUDES ANY CONDITION THAT MAY REASONABLY REDUCE JUDGMENT, REACTION TIME, MOTOR SKILL, ATTENTION, OR SAFETY PERFORMANCE.
FEDERAL LAW AND REGULATORY AUTHORITY: HERPTIVARIUS, LLC OPERATES IN COMPLIANCE WITH FEDERAL LAW AND REGULATORY STANDARDS. WHERE FEDERAL, STATE, AND LOCAL LAW CONFLICT OR CREATE OPERATIONAL RISK, THE COMPANY SHALL APPLY THE STANDARD NECESSARY TO ENSURE MAXIMUM SAFETY, REGULATORY COMPLIANCE, AND RISK MITIGATION.
DOT-ALIGNED SAFETY-SENSITIVE STANDARD: TO THE EXTENT ANY COMPANY ACTIVITY INVOLVES TRANSPORTATION FUNCTIONS THAT ARE REGULATED OR SAFETY-SENSITIVE UNDER U.S. DEPARTMENT OF TRANSPORTATION STANDARDS, INCLUDING BUT NOT LIMITED TO COMMERCIAL TRANSPORTATION RULES, CARRIER REQUIREMENTS, OR SAFETY-CRITICAL DRIVING OR HANDLING TASKS, HERPTIVARIUS, LLC SHALL APPLY A DOT-ALIGNED ZERO IMPAIRMENT STANDARD. THIS MEANS NO INDIVIDUAL MAY PERFORM SAFETY-SENSITIVE WORK WHILE USING OR UNDER THE INFLUENCE OF MARIJUANA OR ANY CONTROLLED SUBSTANCE, EVEN IF SUCH SUBSTANCE MAY BE LAWFUL UNDER SOME STATE LAWS. WHERE DRUG AND ALCOHOL TESTING, INCIDENT REPORTING, OR REMOVAL-FROM-DUTY PROCESSES ARE REQUIRED BY LAW, CONTRACT, INSURER, OR TRANSPORT PROVIDER RULES, SUCH REQUIREMENTS SHALL CONTROL.
NO DRUG USE IN OR AROUND TRANSPORT OPERATIONS: POSSESSION OR USE OF CONTROLLED SUBSTANCES IN CONNECTION WITH ANY VEHICLE OPERATION, PICKUP, DELIVERY, SHIPPING HANDOFF, OR LOGISTICS ACTIVITY IS STRICTLY PROHIBITED. THIS INCLUDES PRE-TRIP, IN-TRANSIT, AND POST-DELIVERY PERIODS WHERE THE INDIVIDUAL REMAINS RESPONSIBLE FOR COMPANY SAFETY OR PROPERTY. THE COMPANY MAY REQUIRE THAT INDIVIDUALS STAND DOWN FROM DUTIES WHERE SAFETY RISK EXISTS.
PRESCRIPTION MEDICATIONS: THE LAWFUL USE OF PRESCRIBED MEDICATIONS IS PERMITTED ONLY WHERE SUCH USE DOES NOT IMPAIR PERFORMANCE OR SAFETY. INDIVIDUALS ARE RESPONSIBLE FOR DETERMINING WHETHER A PRESCRIPTION MAY AFFECT FITNESS FOR DUTY AND MUST NOT PERFORM COMPANY-RELATED FUNCTIONS IF IMPAIRMENT IS PRESENT. HERPTIVARIUS, LLC MAY REQUIRE TEMPORARY REMOVAL FROM DUTIES WHERE SAFETY RISK EXISTS.
ATF-REGULATED ITEMS AND HIGH-RISK CONDUCT: WITHOUT IMPLYING OR CREATING ANY OBLIGATION TO PROVIDE FIREARMS-RELATED SERVICES, HERPTIVARIUS, LLC RECOGNIZES THAT CERTAIN ITEMS AND CONDUCT ARE HEAVILY REGULATED AT THE FEDERAL LEVEL, INCLUDING BY THE BUREAU OF ALCOHOL, TOBACCO, FIREARMS AND EXPLOSIVES. ACCORDINGLY, DURING ANY COMPANY-RELATED ACTIVITY, NO INDIVIDUAL MAY BRING, POSSESS, TRANSFER, DISPLAY, OR DISCUSS TRANSACTIONS INVOLVING ATF-REGULATED WEAPONS OR EXPLOSIVES, OR ANY OTHER REGULATED ITEM OR ACTIVITY THAT WOULD CREATE SAFETY RISK, COMPLIANCE RISK, OR MISUNDERSTANDING ABOUT THE NATURE OF THE COMPANY’S OPERATIONS. THIS POLICY IS A RISK-CONTROL MEASURE INTENDED TO KEEP COMPANY OPERATIONS CLEARLY WITHIN THEIR STATED COMMERCIAL SCOPE AND TO REDUCE SAFETY AND LIABILITY EXPOSURE.
JURISDICTIONAL RISK AND TRANSPORT LIMITATIONS: BECAUSE LAWS VARY RAPIDLY BY JURISDICTION AND TRAVEL CORRIDOR, HERPTIVARIUS, LLC WILL NOT ALLOW ANY CONDUCT OR POSSESSION THAT COULD CREATE CROSS-JURISDICTION LEGAL EXPOSURE DURING COMPANY-RELATED TRAVEL, INCLUDING THROUGH RESTRICTIVE MUNICIPAL OR STATE AREAS. WHEN IN DOUBT, THE STRICTEST SAFETY AND COMPLIANCE INTERPRETATION SHALL APPLY.
NO ACCOMMODATION FOR MARIJUANA USE WHERE SAFETY RISK EXISTS: HERPTIVARIUS, LLC DOES NOT ACCOMMODATE THE USE OF MARIJUANA OR THC PRODUCTS AS A WORKPLACE OR OPERATIONAL MODIFICATION WHERE SAFETY, ANIMAL WELFARE, TRANSPORT RISK, REGULATORY COMPLIANCE, OR OPERATIONAL INTEGRITY MAY BE IMPACTED. THIS POLICY IS APPLIED IN A NON-DISCRIMINATORY MANNER CONSISTENT WITH APPLICABLE LAW.
INVESTIGATION AND RECORD INTEGRITY: WHERE PERMITTED BY LAW, HERPTIVARIUS, LLC RESERVES THE RIGHT TO INVESTIGATE SUSPECTED VIOLATIONS OF THIS POLICY, INCLUDING REVIEW OF INCIDENTS, OBSERVATIONS, COMMUNICATIONS, AND OTHER INFORMATION REASONABLY NECESSARY TO PROTECT SAFETY AND OPERATIONS. THE COMPANY MAY REQUIRE COMMUNICATIONS REGARDING VIOLATIONS OR SAFETY ISSUES TO BE IN WRITING TO PRESERVE RECORD INTEGRITY.
ENFORCEMENT AND CONSEQUENCES: VIOLATION OF THIS POLICY CONSTITUTES A MATERIAL BREACH AND MAY RESULT IN IMMEDIATE REMOVAL FROM DUTIES, TERMINATION OF EMPLOYMENT OR CONTRACTUAL RELATIONSHIP, REFUSAL OF FUTURE SERVICE, AND WHERE APPLICABLE, REPORTING TO INSURERS, PLATFORMS, REGULATORY AUTHORITIES, OR LAW ENFORCEMENT CONSISTENT WITH APPLICABLE LAW. ENFORCEMENT IS BASED ON CONDUCT AND SAFETY RISK, NOT ON THE LEGAL STATUS OF A SUBSTANCE UNDER STATE LAW.
NO WAIVER AND CONTINUING OBLIGATION: FAILURE TO ENFORCE THIS POLICY IN ANY PARTICULAR INSTANCE SHALL NOT CONSTITUTE A WAIVER. COMPLIANCE WITH THIS POLICY IS A CONTINUING CONDITION OF ENGAGEMENT WITH HERPTIVARIUS, LLC.
MODIFICATION AUTHORITY: HERPTIVARIUS, LLC RESERVES THE UNRESTRICTED RIGHT TO MODIFY THIS POLICY AT ANY TIME TO REFLECT CHANGES IN LAW, SAFETY STANDARDS, INSURER REQUIREMENTS, OR OPERATIONAL RISK. CONTINUED ENGAGEMENT WITH THE COMPANY CONSTITUTES ACCEPTANCE OF ALL REVISIONS TO THE MAXIMUM EXTENT PERMITTED BY LAW.
